Changes to privacy law would cover the cloud

A generation ago, when the Electronic Privacy Communication Act was passed,?"the cloud," a term for massive?server?storage of private?emails, documents and photos, didn't exist. Now some?lawmakers are looking to amend the 1986?law so that information stored in the cloud would require a warrant by the police who want that information from either the cloud?storage provider or the individual.

That amendment to the?Electronic Communications Privacy Act of 2012, the first major changes to 26-year-old law, is expected to be considered by the Senate Judiciary Committee on Thursday.

Right now, law enforcement needs only a subpoena, issued by a prosecutor, to search cloud-based storage, whether it's for emails or documents that are shared for collaboration?on sites like Google. A bill by Sen. Patrick Leahy, D-Vermont, would instead require law enforcement to obtain a search warrant issued by a judge.

"The bill pending at the Senate Judiciary Committee to update the Electronic Communications Privacy Act is long overdue," said Greg?Nojeim, senior counsel and director of the Center for Democracy & Technology's?Project on Freedom, Security & Technology, told NBC News.

"Requiring a warrant for email and other information stored in the cloud would provide privacy to consumers, certainty to law enforcement, and clarity to the companies that receive law enforcement demands."

The ACLU, too, is backing the change. "We believe the statute is very out of date," Christopher Calabrese, ACLU legislative counsel, told NBC News. "All email and all private communications should be covered by a warrant," and not just a subpoena.

Law enforcement groups are opposing the cloud-based?warrant requirement.?The battle comes as courts continue to?wrangle?over whether law enforcement should be allowed to track an?individuals'?cellphone information?without a warrant.?

"The crime scene of the 21st century is filled with electronic records and other digital evidence," wrote?representatives of various investigative, legal and police agencies via the National Sheriffs' Association?in a?letter to the Senate Judiciary Committee.

If anything, the agency representatives said in the letter, "laws, policies, protocols, and practices related to the process of law enforcement evidence retrieval from communications service?providers are out-of-date and increasingly insufficient moving forward."

It comes from A Year of The Best from The Best of Bridge. It?s a seasonal cookbook that has lots of tasty recipes that have become favorites around our house. Though a lot of what you may find in them may not be whole food recipes, there?s enough of them that are to make it worth keeping the cookbook around, with some real gems scattered throughout. This is one of those gems.

This butternut squash apple soup is easy to make and it barely requires a recipe, once you?ve made it a couple of times. I served this as our first course for Thanksgiving diner this year. I made it ahead and froze it, so come the big day, I could thaw, reheat and serve over little cubes of Camembert cheese sitting at the bottom of the bowl. Yum.

There?s something so great about dipping your spoon into a bowl of rich and creamy butternut squash soup and to get a spoonful of gooey cheese. The cheese melts into a velvety unexpected layer. Of course this is easy to make into a vegan soup by omitting the cheese. It?s still delicious without!

Butternut squash soup with apples and Camembert

6 cups roasted butter squash (approximately 2 medium sized squash)

1 large leek (or 3 small), whites only, sliced

2 carrots, cut into 1 inch pieces

2 medium onions, diced

1 tablespoon olive oil

2 apples, peeled, cored and chopped

1 bay leaf

8 cups of vegetable stock or chicken stock

salt and pepper to taste

1 inch cube of Camembert per person, rind removed

To roast the squash, preheat the oven to 375 degrees F. Cut each squash in half length wise. Place face down on a baking pan. Roast until soft when poked with the tip of a knife, approximately 45 minutes. Scoop out the seeds and discard (also good for making roasted seeds), scoop out the flesh of the squash using a large spoon and discard the skin.

In a large pot, cook the leeks, carrots and onions with 1 tablespoon of oil until the onions become soft. Add the apples, bay leaf, stock and cooked squash. Simmer for 40 minutes. Remove the bay leaf and blend with an emulsion blender until smooth. Or use a blender or food processor. Just be mindful to let the soup cool down before attempting that! Reheat soup if necessary before serving.

Place a 1 inch cubes of Camembert at the bottom of each bowl. Pour hot soup over cheese and serve immediately.

*Optional: Garnish with bacon bits

Boston College fires football coach Spaziani

BOSTON (AP) ? Boston College has fired football coach Frank Spaziani after four years of progressively worse records and two straight seasons without a bowl appearance.

New athletic director Brad Bates made the announcement on Sunday, a day after the Eagles (2-10, 1-7 Atlantic Coast Conference) finished the season with a 27-10 loss at North Carolina State.

"A personnel decision of this magnitude affects many people and is never taken lightly, but I felt a change was necessary," Bates said in a news release sent shortly after an email to season ticket-holders.

The decision was widely expected, and Spaziani all-but spoke openly about his understanding that it would be his last year. Asked on Saturday if he would make his case to stay, Spaziani told reporters in Raleigh, N.C. after Saturday's game, "I do have a case."

"Obviously this is a sad day for my family and me," Spaziani said in a statement released by the school. "Boston College has been my home for more than 16 years, and I have been fortunate to work with some amazing student-athletes. I will always treasure my relationships with them and the BC staff. Boston College is a tremendous place, and I am extremely thankful for my time there. I wish the current and future Eagles nothing but the best."

Spaziani, 65, spent 12 years as a BC assistant, the last 10 as defensive coordinator, before taking over when Jeff Jagodzinski was fired for interviewing for an NFL job. The Eagles won eight games his first season, seven the next and four last year.

A New Jersey native who played for Joe Paterno at Penn State, Spaziani had three years remaining on a contract that paid him $1.1 million per year.

Including the bowl game he coached after Jagodzinski was fired, Spaziani had a record of 22-29 at BC.

"It is with gratitude that we recognize the many contributions Coach Spaziani has made to Boston College during his 16 years in Chestnut Hill," Bates said. "He displayed unwavering dedication and loyalty to our institution and our football student-athletes, while consistently representing Boston College with class and dignity. He and his staff have devoted countless hours to our student-athletes and the BC community. We thank them and wish them well."

Bates was hired last month to replace Gene DeFilippo, who retired after 15 years. The new AD said he would begin searching for a new football coach ? his first major hire in the job ? immediately.

"We will be seeking a leader whose vision of our football program mirrors the mission of our university, who values the development of our student-athletes and whose goal is to return our program to national prominence," he said. "Our fans and the entire University community value the rich tradition of Boston College football, and we are committed to making it a successful program."

When you hear the word ?exercise?, do you just want to cringe? Is it a bad word that implies that you have to do something that you don?t want to do? Something you dread?

Exercise has such a negative connotation to it that most people try to close their ears the minute they hear the word begin. It?s like it?s some virus that has negative consequences. However, that thought couldn?t be any further from the truth.

There are many benefits of exercise. Here are just a few:

Greater overall health. If you keep your body strong and fit, you?re more likely to avoid or at least reduce your risk of certain diseases associated with being overweight and out of shape, like heart disease, type 2 diabetes and more. And, the better your health, the longer you live.

Better sleep. When you engage in regular physical activity, your body is tired by the end of the day and your sleep tends to be deeper and more rejuvenating. You don?t spend as much time tossing and turning.

Improved mood. When you exercise, your body releases endorphins. This greatly improves your mood and helps you retain a positive outlook on life.

Less stress. There is no better way to get rid of stress, anxiety and frustration that to work it out of your body by doing cardiovascular exercise or strength training. Not only do you release the physical tension but it also takes your mind off whatever is bothering you when you?re paying attention to your workout.

Improved sex life. When you?re feeling good and have a higher level of self-confidence, it comes out in the bedroom. Sex is more satisfying when you aren?t spending the whole time worrying about how your body looks.

Exercise is good for you. Make it a positive word and enjoy the benefits!

Ohio firm makes contest out of energy savings ? Business ...

In their quest to leave a smaller environmental ?footprint,? employees of Greif, a Delaware, Ohio-based industrial packaging products company, are trying to outdo each other when it comes to energy-efficient work habits.

For four months, 60 of the organi?zation?s employees participated on two teams that competed to identify energy wasters and control energy use at work. To do so, they used ?modlets??moni??tors that reveal how much energy devices plugged into an electrical outlet are using and can automatically shut them off at pre-programmed times.

That helped employees learn about ?phantom power,? the electricity that an appliance or computer uses even when it?s turned off, and about how much energy they waste by failing to unplug or shut down electronics when they?re not in use.

The two teams competed to save more energy and learn more about energy than the other, earning badges and points for participating in learning activities. For example, one activity encouraged participants to identify active and standby power states of the devices monitored by their modlets.

Result: Even after the competition has ended, employees are still talking about energy savings, using less energy and convincing their colleagues to do the same.

Many people have unrealistic and idealized expectations of love relationships. They believe that the excitement and emotional highs of new love will last forever. It comes as a huge shock when the euphoria wears off and disillusionment sets in. Couples often struggle with this change, believing they have ?fallen out of love? and wonder what to do next.

So why does love change from feeling great to feeling wrong once you take that step of commitment?? One reason is that relationships go through predictable stages, and by understanding these stages, couples can be better prepared to maneuver each stage successfully? be less likely to blame their partner or experience self-doubt about their relationship choice.

So let?s take a look at these stages:

There are 5 stages of love that have been identified by Dr. Susan Campbell. All couples move through the different stages at different speeds and will move back and forth from stage to stage but both will predominately be in the same stage at the same time:

? Romantic Love Stage

? Power Struggle Stage

? Stability Stage

? Commitment Stage

? Co-Creation Stage

Stage I ? Romantic Love

All relationships begin with this stage. The need satisfied here is love and belonging. This stage is characterized by its dream-like qualities, fantasies, hopes for the future, the possibilities and the asking of ?what if.? Everything is wonderful, beautiful, fun and exciting.? The pair unfortunately are brain dead! They focus on similarities and do things to please each other.

Differences are viewed as bad so are denied. The emphasis is on how to fit and move together and soon they look like they?re glued together at the hip. Each will do anything to get along. You deny part of yourself and the thinking is ?Now that I have this other person I am complete and happy.? This stage is short lived but does allow for the building of a foundation for the relationship in the future. However, real love cannot begin at this stage so paradoxically one must fall out of love to learn to love.

This stage lasts, on the average, two months to two years. Romancing takes up a lot of energy with all the courting and pretenses and trying to be the same ? eventually you begin to tire. As well, melding at the hip becomes uncomfortable. When the cost to your individuality becomes too great you begin trying to change the other person or make them conform.? Guess what you get? Resistance with a capital ?R?; but you try to insist and there is a fight, leading to the next stage, which is ?

Stage II -Power Struggle

In this stage both parties struggle for power and some freedom. There is an awareness now that you are different but the premise remains that differences are bad ? your differences are magnified. You seem to have nothing in common anymore and everything the other person does is wrong. There is a pulling away from each other, and a need for space ? all of which is quite normal.

This is a critical stage where divorce occurs most frequently and when couples seek counseling. The fight is for boundaries and clearly defining unacceptable bottom line behaviors.? There is a nervousness about the future and some questioning whether there will even be a future together. This stage is a prerequisite to readiness to relate to each other as whole people.

See this stage as a positive one, an opportunity to journey together, to learn how to negotiate, to equally care about your needs getting met as you do about your partners. It is possible to have one partner still in the romance stage while the other is into the power struggle stage. This can be painful when the one in the romance stage finds that what he or she does for love and belonging leaves the other feeling oppressed (i.e., he brings you flowers which was once okay but now you feel controlled by his actions and react by desiring even more space).

Stage III ? Stability

The needs satisfied in this stage is freedom and choice. You are now aware of each other?s personal world instead of just your own and the difference is okay. It is finally clear you are not going to reshape your partner. Clear boundaries are determined.

There is a sense of loss and a certain sadness at this time as your realize dreams aren?t reality. The power struggle was hard and has weathered you. You feel older and wiser. If you had not learned good relationship and coping skills as a child the power struggle stage was even harder than it had to be.

This is a resting time. The war is over and it?s time to relax. You breathe a sigh of relief. The danger at this stage is you may start to move apart as each does their own thing. There is a realization that each other?s? paths in life may be different. There may be a feeling of boredom, a sense of not being connected and having nothing in common.

This is the second most common stage for counseling or divorce. At first it feels good to agree to stop changing the other but life is not like that. Life is about growing and changing. The positive aspect is that at this stage you have history and it can be used to your advantage. Don?t throw away the relationship easily. At this time you either learn mutual respect or you go back to the second stage.

Stage IV ? Commitment

This is the only stage where there really is a readiness for marriage though people usually have already married in the romance stage. In this stage you are wide awake, making clear choices about yourself and your partner, based both on individual differences and those things you have in common. You see clearly who you are and what you want as well as who your partner is and what they want. This is the basis of a healthy relationship.

You now choose each other with awareness of past, present and direction to the future. The needs fulfilled here are a balance of love, belonging, connection, fun, and freedom. You don?t need each other, you choose to be with each other.

If one of you is in the stability stage and one ready for commitment, you will either both remain in stage three or could return to stage two. Both need to be ready for the commitment stage. Though parts of previous stages may reappear you probably would have done enough work to have developed strategies for dealing with problems. The statement can now be made to your partner, ?I choose to love you knowing all I know, good and bad.?

Stage V ? Co-Creation/Bliss

In this stage you are two people who have decided to be a team moving out into the world. This world may include children, a project, a church, a joint business venture, etc. You move beyond the relationship. The danger at this stage is over involvement with the outside world and relationship being neglected. The relationship must be continually nurtured along the way. There needs to be time for you, for me, for us and for them. This is difficult sometimes and choices must be made.

A test of where you may be in the relationship is: If your spouse and children are away for a while, who gets the first hug upon their return? If it?s the kids then maybe it?s time to take a better look at ?us.?

These stages are not a linear process; it is a circle spiraling upwards so when you hit a ?certain stage in the power struggle it becomes easier. You retain stages and bring them forward as you grow ? you are in one stage or another at any given time with bits of the others thrown in for good measure. Knowledge of the stages helps move through them.

Violin bow maker keeps his craft alive

In a small, sun-drenched studio outside of Boston, Benoit Rolland runs his hand over thin, dark planks of wood. He taps them to demonstrate how the percussive sound of each species varies. The pitch is higher in one plank, the reverb more durable in another.

By his count, Rolland is one of only a handful of people in the world who makes custom bows for violins, violas and cellos. It?s a traditional kind of work ? another Frenchman, Fran?ois-Xavier Tourte, settled the form of the bow in the 18th century, and most bows today are based on this design.

Though Rolland?s name might not?be widely known, his bows are played on instruments with recognizable names like Stradivarius and Guarneri. Rolland has been making custom bows since the early '70s, and today he can produce as many as 30 in a year, selling them for up to $15,000 apiece.

In almost any other field, a machine would have replaced his job, but his clientele are the professional musicians who travel the world performing at the top of their field.

Befitting such an expensive piece of equipment, Rolland?s process for designing a bow is very specific. It begins with a private audience.? If a customer lives abroad, he asks for them to send an audio recording.

?After a small while, I?m able to guess the bowings,"?Rolland said. "And then the fingerings. And the fingerings are very important, because they are linked to the bowings. And the bowings are linked to the fingerings.??

"It's a circle,"?Rolland explains. "When I can get into that circle, I have a fair idea of who I?m working for.?

After listening to the performer, Rolland chooses a specific wood and works up a design that accommodates their strengths and weaknesses. He prefers to use a species of Brazilian wood called pernambuco,? celebrated for its tone, strength and longevity.

Unfortunately, pernambuco is an endangered species, and it?s impossible to buy more of the rare timber.

Rolland has a stockpile of the wood that he hopes will last the rest of his life, but anticipating the eventual disappearance of pernambuco, he began experimenting with alternative materials. In the 80s, he was one of the first people to create a bow from carbon fiber.

Unlike the warm sound of a wooden bow, Rolland says, ?Carbon fiber conveys a very fast vibration. It?s not an advantage. We have to damp the vibration a little bit to give more warmth through the sound.?

His innovations have won him recognition. In October, he was awarded a MacArthur Fellowship, also known as a ?Genius Award,? for the improvements he has made to the enduring wooden stick.

One of his recent changes to bow design was to slightly alter the angle at which the bow hair sits on an instrument, yielding greater sound and improved control.

?I do not plan nor intend to change the sound of the violin, otherwise it wouldn?t be a violin anymore," he says. "But, you know, violin playing is very difficult.?

When asked what he has in store, he demurs. ?I have several inventions that are cooking,"?he says with a grin. "I don?t say that because I?m French. ?

Safe cycling campaign to launch

Police will hold a citywide safe cycling campaign from November 23 to 29, taking stringent enforcement action on cyclists disobeying road rules.

Police today reminded cyclists they are subject to the Road Traffic Ordinance and must obey all traffic laws.

?

Between January and October, there were 2,180 traffic accidents involving bicycles, resulting in 2,054 cyclist casualties. The figures are up 13% and 14% on last year. Nine cyclists died in traffic accidents in the first 10 months of this year, seven less than in the same period last year.

?

Common cycling offences include failing to comply with traffic signs or road markings, riding on the footpath, carrying another person, carrying any animal or article which obstructs the cyclist's view, and riding without lights.

It's a minor move, but the app that never even acknowledged the desktop world until recently is taking its first notable step to promote Web Profiles. Instagram has today launched Badges, which are intended to help users "link to and promote one's Instagram web profile." Sure, designers with the right skill set have been able to do similar for some time, but now it's easy. Just surf over to your web profile, hit your username and select 'Badges' from the drop down menu. And just like that, you'll be on your way to adding yet another little icon to your About.me page -- not like things weren't crowded enough with Twitter, YouTube, LinkedIn, Facebook, MySpace, Flickr, Google+, Tumblr, Formspring and Foursquare already.

Countdown to Thanksgiving ? The Full Moxie:: Celebrity ...

Kind of a big day on the horizon. While we are one giant melding pot of a country and don?t get credited for much of anything original, we do have a few things that are our very own inventions: baseball and basketball; the 8-track tape; and Thanksgiving. And oh, how we love a good feast.

The issue with this day of gluttony ? other than trying to find elastic waist pants we still look good in ? is that, for the host? There is a plethora of tidbits to which one must attend. And if one is hosting a rather large crowd, well? those details, large and small, can really ratchet up the stress.

In an effort to help reduce the stress in your life, here are some things to consider at T minus 7 days and counting.

1) Plan your menu. What are you thinking of serving? Generally speaking, most Americans go the turkey/mashed potatoes/ stuffing/ green bans/ cranberry sauce/ pumpkin pie route. But maybe this isn?t the menu for you? Maybe you have a few traditional recipes you like to throw down, or a vegetarian is coming to dinner? Whatever the case, grab a sheet of paper and write down ALL THE THINGS you plan on serving, from appetizers to the main meal to dessert, plus beverages.

2) Make your shopping list.Take a look at your menu, and catalogue everything you?ll need for every dish. Example:

Mashed potatoes: Russet potatoes, butter, milk, sour cream

Green Bean casserole: Frozen green beans, cream of mushroom soup, Fried onions?

Here?s the thing: I know this all seems terribly obvious, but there will come a point when you will be grateful for being overly prepared. And that point will be exactly at 3:00 in the afternoon on Thanksgiving, when you remember you forgot to start making the cranberry sauce and low and behold, no one needs to run to the store because you already have all the stuff you need. IMAGINE THAT.

3) Math time. Now that you know what you?ll be having, do a quick head count of your guests, and look back at your list. Time to to do that math thing! Consider portions: Will you need one small bird, or 2 giant ones? ?Five or ten pounds of potatoes? ?How many pies? Now?s the time to figure out how much you?ll need of everything? and whether you?ll have room for it all in your kitchen.

4) Do your shop.?Knowing the vast ? or not ? amount of food you?ll need, think about freshness. What can you get 5 days out that won?t spoil? What about 2 days out? Break down your list into manageable chunks, and get what you can when it is most appropriate to get it. Too many times have I waited to buy ALL THE THINGS on Thanksgiving eve, only to discover that the store had already been ransacked of many of the packaged items I could have taken care of days before. BE YE NOT SO STUPID! If you can take care of it a few days ahead of time and shelve it, do it. This will also make unloading your groceries a little easier.

5) Plan your cooking times & make ahead. So now you have a ton of food and in most cases, a frozen bird. Depending on size, it could take up to a few days to thaw a turkey. Think about that when planning your cooking times. And how will you thaw your bird? There are several ways to do this SAFELY ? check out the USDA?s website for the basics.

Along with that, think about how soon can you begin your prep work on the rest of the meal. Chopping, dicing, slicing, peeling, mixing, baking and roasting all takes time, and if you are your kitchen?s lone soldier, try to give yourself as much prep time as possible. We?re talking about a feast here; if most of the cooking is on your shoulders, give yourself as much time as possible so you can complete each task. Get your stuffing and casserole veggies sliced and cheeses grated a couple days in advance and zipper bag those suckers.?If you can bake two days ahead of time, do it. Any little bit you can do along the way will reduce and or negate last minute stress.

6) Clean the house.?Ugh, yeah. That. Trust me on this: the last thing you?re going to want to do is scrub your toilet ten minutes before your guests arrive. Personally, I find having a clean home?before?I launch into a two-day cooking marathon reduces my level of panic. You?ve got time: de-clutter.

7) Prep your table.?Setting your table a day ahead helps avoid last minute scurrying for extra forks and chairs. I covered this very issue last week, but as a reminder: along with the guest count, consider what you?re serving as well. Will you need bowls and spoons? Do you have enough plates? How are you serving dessert. There are important things to consider ahead of time; be sure that you do.

8) Lay your clothes out.?Seriously, you do this every year. An 45-minutes before guests arrive, life will find you standing in your closet, half wet from the shower and wonder what on Earth you can still fit into that isn?t ripped, stained, or just not right for the occasion. For the fun of it, why not pick out an outfit a few days ahead of time? Seriously, go look in your closet, find the clothes, the shoes, the socks or stockings ? whatevs ? and set them aside. Bam. Done. Just saved yourself a good hour of panic.

9)?Get your camera ready. Are you going to remember it this year? Yes, you are. Charge the batteries or buy new ones. Make sure you?ve got your film situation covered.

10) ?Entertainment. Last year, all my family wanted to do was sit and watch the 49er?s game. Problem: It was on a special cable channel to which we needed to subscribe, and my hubs spent the 20 minutes leading up to kickoff scrambling to connect with anyone from the cable company ? on a major holiday ? who could assist us with subscribing immediately. ?In the end, we got the game on, ?but a little planning could have saved the stress. That said, there are all kinds of family traditions on this day.?If you play board games, do puzzles, play an annual football game ? now?s the time to start locating your entertainment.

The downside to all this? It all seems like a lot to think about. The upside? You?re going to have to deal with all this stuff at some point, why not get a step ahead?

Population of Africa's mountain gorillas rises

The population of Uganda's mountain gorillas has grown to 400, up from 302 in 2006, according to a census conducted last year, bringing the total number of mountain gorillas in Africa to 880 and giving hope to conservationists trying to save the critically endangered species.

Uganda is now home to nearly half of the world's mountain gorillas remaining in the wild, a source of confidence for a country that has come to depend heavily on the popular apes for substantial tourism revenue. The rest of the surviving mountain gorillas - the species Gorilla beringei beringei - are in Congo and Rwanda.

"The increase in the population of mountain gorillas in Bwindi Impenetrable National Park is testimony to the sound natural resource management policies that are being implemented in the protected areas," Uganda's Ministry of Tourism said in a statement received Friday. "This result confirms beyond reasonable doubt that Uganda's conservation efforts are paying off."

Bwindi Impenetrable National Park, a network of forested jungle deep in the country's southwestern frontier, is recognized by UNESCO as a heritage site of world value. A permit to track gorillas there costs at least $500 and the World Wildlife Fund estimates that each gorilla brings in up to $1 million in revenue each year for the East African country.

The census shows a stunning recovery for a species that once faced a real threat of extinction. Mountain gorillas in the wild still face threats ranging from habitat loss to poaching, especially in Congo, where lawlessness in the country's vast eastern territory has allowed illegal hunters to prosper. Mountain gorillas are hunted for their meat in Congo, according to the World Wildlife Fund.

Even a common cold can kill a mountain gorilla, as species is particularly vulnerable to respiratory diseases usually associated with humans.

The conservation group Gorilla Doctors said the population growth was partly due to "extreme conservation" methods such as daily ranger monitoring in the forest. Ugandan wildlife officials have been able to build successful partnerships with local communities in part by pouring some of the revenue into local projects, converting previously hostile groups into friendly advocates for the gorillas' survival.

"The mountain gorilla is the only non-human great ape that is actually growing in number," said Mike Cranfield of Gorilla Doctors. "The growth of the mountain gorilla population can be attributed to the intensive conservation and collaboration between multiple conservation groups and government authorities."

'Glee': Cassandra And Kitty Prove Cruelty Can Come From People Of All Ages (VIDEO)

Who said catty and immature vindictiveness gets left behind when people graduate high school? Cassandra proved that even college teachers can be needlessly cruel on the latest episode of "Glee." She encouraged Rachel to head back to Lima to see the McKinely High production of "Grease," but she clearly had motives of her own. In the same moment, she invited Brody to be her T.A.

Knowing that Rachel had feelings for Brody, Cassandra took advantage of Rachel being away to make her move. And it worked. Even better -- for her at least -- she was there to pick up his phone when an emotionally vulnerable Rachel called. She then proudly presented how she'd slept with Brody as if this was a life lesson that was going to help Rachel grown, when really it was about lashing out because of her own bruised ego. Rachel had dared suggest Cassandra try out for a production that Rachel was going for.

High school cruelty was on full display as well -- and perhaps even worse than what Cassandra was doing. Once again, jealousy was at the root of it. Kitty started restitching Marley's Sandy costume so that it wouldn't fit. Then, because Marley's mother is the obese school lunch lady, Kitty could prey on Marley's fears that she will gain weight as well. She even encourages her to start vomiting to lose weight.

Family of murder victim Cukor files suit against Berkeley | Berkeleyside

The family of Peter Cukor, killed by a mentally disturbed man outside his Berkeley hills home on February 18, filed a wrongful death lawsuit Thursday against the city.

R. Lewis Van Blois, the Cukor family attorney, charged in the lawsuit that the city and police acted grossly negligently in their handling of Cukor murder. At the core of the case is the issue of how seriously police took Cukor?s call and how promptly officers responded.

?Peter Cukor had called the Berkeley Police Department on their emergency number for help to request a police officer be sent to their home right away because the intruder was attempting to get inside the Cukor home and was acting strangely,? Van Blois said in a press release. ?The police dispatcher promised to get someone to their home soon and the Cukors relied on this representation. In fact, the Berkeley Police Dispatcher never intended nor requested a police officer to respond and when a police officer called to say he could respond to the call, he was told not to go. Soon thereafter, the intruder attacked Peter Cukor and fatally struck him on the head with a flower pot.?

Berkeley Police Chief Michael Meehan has previously defended his department?s actions, saying that officers responded in a timely fashion.

The suit asks for unspecified damages for emotional distress for Cukor?s wife, Andrea Cukor.

?His wife witnessed everything,? said Van Blois. ?She heard everything. She saw him get dragged down and struck. She watched him kill her husband. If you can imagine watching your husband get killed right before your eyes and hearing and seeing it, it?s devastating.?

Cukor, 67, and his wife returned to their 2 Park Gate Road home around 8:45 p.m. on Feb. 18 and encountered Daniel DeWitt, who told them he was looking for a ?Zoey? he said he believed lived there. DeWitt is schizophrenic and had stopped taking his medications. Cukor told DeWitt to leave, and entered the house where he called Berkeley police at 981-5911 from his cell phone to report the intruder.

Since Cukor spoke in a calm voice and called on the police ?non-emergency number,? the police dispatcher determined it was a Priority 2 call, which must be responded to within 20 minutes, rather than a Priority 1 call which means there is a crime in progress or life threatening emergency and gets immediate response, according to statements made by Berkeley police officials after the murder.

But the police were in the middle of a shift change and were anticipating trouble from an Occupy march that was scheduled to go from Oakland to UC Berkeley that night. Top police officials wanted to brief the incoming officers on the march and ordered that no Priority 2 calls get answered.

One police officer allegedly called in to dispatch and offered to take any calls, according to the San Francisco Chronicle and the lawsuit. He was told not to respond.

The lawsuit charges that this diversion was negligent. Meehan has said that there were other Priority 2 calls in the hopper at the time, and there is no guarantee that the officer would have been sent to the Cukor home, which was two miles from the officer, who was at Shattuck and Cedar. The officer might have been sent to the other pending Priority 2 calls, which included a fire and another suspicious person, because they were closer, said Meehan.

Regardless, Berkeley police did not dispatch any officers to the Cukor home after that first call. But Peter Cukor thought the police were coming and was concerned they couldn?t find his driveway since it is in a remote spot, according to the lawsuit. So he walked back out to his driveway to try to get the police?s attention, according to the lawsuit. He once again encountered DeWitt, who attacked him.

Andrea Cukor then called 911 to report that the intruder was beating her husband. Police responded immediately and arrested DeWitt a short time later. He was charged with murder but the charges were stayed while he is treated at Napa Valley Hospital, a state mental institution.

Cukor died later that night of his wounds.

The lawsuit contends that Cukor did call police on an emergency number since the police department website lists 981-5911 as a number to call in an emergency. And Cukor?s tone should not have mattered.

?Describing a very threatening individual that?s acting crazy, that?s six feet four inches tall, that?s outside and won?t go away ? why would he call just to have a nice little chat with a communications person?? said Van Blois. ?If he asked calmly or he was yelling, it should make no difference. He wanted help. ?

In August, Berkeley rejected the Cukor family?s initial claim against the city, said Van Blois, paving the way for the filing of the lawsuit.

Major retailer, American Apparel, recently received heavy criticism, after sending out an obnoxious email blast amidst Hurricane Sandy, which is now known to have caused substantial damage, and many deaths in the Northeast.

They weren?t, however, the only major retailer to ruffle the feathers of fellow tweeters. Popular clothier, Gap, posted an insensitive tweet while Hurricane Sandy was making its way towards the East Coast.

To be fair, American Apparel and Gap wasn?t the only businesses that took advantage of the disaster. They just so happened to be the most publicly damned business as a result of one little marketing blunder. Regardless of whether or not you feel they deserved the backlash or not, and regardless of whether or not it was all a publicity stunt, there are five clear lessons to be learned from their mistakes.

1.??? Don?t be a Shill

Shill (n.): A decoy who acts as an enthusiastic customer in order to stimulate the participation of others.

Gap?s sly tweet (above) attempts to trick their followers into actually believing that the tweet was posted by genuinely excited customers, ready to shop their little hearts out during the storm, and that their followers, in turn, should get equally excited. In actuality, this is not the case. The account is obviously run by an employee of the Gap who is responsible for managing their social media, not real customers.

One angry customer replied to Gap?s tweet, ?Try taking a break from being a shill for a couple of days instead of trying to tie in a life-threatening storm warning to your ads?? A comment on Mashable?s article also stated, ?I get the tweeter?s comment that the company should ?stop being a shill.? The key lesson to be learned here is that if you want to promote your products in social spaces, don?t be deceitful and pose as something you?re clearly not, especially amidst an approaching tragedy. ?

2.??? Be Sensitive and Considerate

You?ve already got the odds stacked against you. Why? You?re a business? you know, a profit driven, ruthless entity. Social media, then, will be the one thing to humble you, my friend. Before you engage, you really need to understand the culture of social media, as shameless promotion simply doesn?t fly. Tragedies and potentially dangerous situations need to be treated delicately. You?re going to rub a lot of people the wrong way if you continue down this tactless path. It?s important to humanize your social media presence so people respect you.

Show them you?re not all about the Benjamins. Show them you care. If you can?t show this to your online community, even when there?s a tropical storm on the way that?s forecast does not look too promising, you?re destined for social condemnation. Another comment in Mashable?s article on Gap?s tweet stated, ?It?s someone like telling you their dad died, you saying ?Oh, that?s sad??. You want to order some Papa John?s tonight?? The key lesson to be learned here is to lay off on the impudent advertising during times of such grave uncertainty and show your followers a little consideration.? Wouldn?t it make more sense to actually provide some help and use the online community to spread the word about your good deeds?

3.??? Offer a Sincere Apology ??

American Apparel has yet to offer a public apology for the controversial email blast. While Gap, on the other hand, did offer an ?apology,? it has been criticized for its lack of sincerity and rationalization.

Another recent post by Mashable stated, ?online reaction to the ad has been overwhelmingly negative? and ?American Apparel did not immediately respond to a request for comment.? The other post by Mashable, however, stated that Gap ?made a mildly insensitive tweet? but then ?took the tweet down and offered the following semi-apology.?

As you can see, the two cases vary in intensity of reaction. The notable difference is that Gap offered an apology but American Apparel did not. Gap?s apology, however, also seems to have slightly backfired. The key lesson to be learned here is to offer not just any ol? apology, but a heartfelt apology. The retailers could have even considered offering a donation to the Hurricane Sandy relief efforts in an attempt to make things right. ?Again, that is what they should have done in the first place.? Clearly, both these major retailers have no concept of ?too soon.? They?ve in fact, gone so far as to be witty just as a life threatening storm was about to hit the East Coast. C?mon now, really? Now is certainly not the time to be ?clever? or to apply cheap, tasteless, newsjacking PR tactics. Ford Transit Connect isn't a minivan

DEARBORN, Mich. ? It looks like a minivan. It has sliding doors like a minivan. So why isn?t Ford calling its new seven-seater a minivan?

For the same reason you don?t wear mom jeans or listen to Barry Manilow: It?s not cool.

The Transit Connect Wagon will debut this month at the Los Angeles Auto Show. It?s set to go on sale late next fall.

To the average buyer ? or, in fact, to everyone outside of Ford Motor Co. ? it will appear that Ford is getting back into the minivan business after a six-year hiatus. The Transit Connect Wagon, which is based on Ford?s Transit Connect commercial van, has the high roof of the van but trades its industrial-looking hood for the tapered nose and trapezoid grille of Ford?s cars. It has sliding doors on both sides and comes in five-seat and seven-seat versions.

THE NEW VEHICLE will have two four-cylinder engine options, one of which will get 30 miles per gallon or more on the highway. That would make it the most fuel-efficient minivan on the market ? if it were a minivan. Ford insists it?s not.

?It?s anything but a minivan,? said David Mondragon, Ford?s general manager of marketing. ?In our mind, it?s a people mover. We think of it as more of a utility, or kind of a hybrid sport utility, than a minivan.?

Mondragon says the m-word is too polarizing and turns off Ford?s target customers: 30- to 42-year-old parents who grew up with minivans and like their utility but don?t want to sacrifice style. At one point, Ford even considered calling the wagon a ?you-tility,? but it turned out another carmaker already had dibs on that one.

?A lot of consumers in this segment are parents who still want their own identity,? Mondragon said. ?There?s a lot of blandness in the industry, especially in regard to multi-passenger vehicles. They want something fresh and uniquely styled.?

The Transit Connect Wagon has a different look from the average minivan. The roof is higher, the windshield has a steeper slant and it?s got a sturdier, more industrial look.

But more important for Ford, the Transit Connect Wagon will be priced like a minivan. The company?s current seven-seaters, the Flex wagon and Explorer SUV, cost $30,000 or higher. While Ford isn?t releasing a price for the new vehicle yet, Mondragon says it will compete at the lower end of the market with vehicles like the Dodge Grand Caravan, a minivan that starts at $19,995.

DEALERS SAY THE vehicle fills a void in Ford?s lineup. The company stopped making the Freestar minivan in 2006, citing falling demand as customers swarmed to new crossovers like the Ford Escape. But the decision cost it some customers who needed the utility of a minivan, says Terry Kidd, who owns Kidd Ford Lincoln in Morrison, Tenn.

?We still sell used minivans. It?s a very popular body style,? he said.

Kidd says the Transit Connect Wagon should be as good ? if not better ? than other minivans on the market. That?s a far cry from the clunky, inefficient Freestar, which had trouble competing with industry leaders like the Honda Odyssey.

Ford has been selling a five-passenger version of the Transit Connect van since 2010, but it?s designed for commercial use and has few creature comforts. The new version will offer lots of bells and whistles, including a panoramic sunroof, leather seats, third-row seats that slide back and forth and the MyFordTouch entertainment system. Its second- and third-row seats fold down to create 100 cubic feet of cargo space behind the first row, or about 20 cubic feet less than the Nissan Quest minivan.

U.S. MINIVAN SALES peaked at 1.37 million in 2000; by last year, they had fallen to 472,398. About 3 percent of new vehicle buyers are purchasing minivans now, down from 6 percent a decade ago, according to Strategic Vision, a consulting firm. Alexander Edwards, who heads Strategic Vision?s automotive division, says Ford can move that needle, but it needs to show what makes the Transit Wagon different ? its optional rear cargo doors, for example ? and target nontraditional minivan buyers such as aging parents and outdoor enthusiasts.

?Yes, the term minivan is polarizing, but for those who are open to a minivan-styled vehicle, most do not care or worry about such stigma,? he said.

The Transit Connect Wagon will be made in Valen?cia, Spain, and exported to the U.S., Asia and Europe. Ford sells about 35,000 Transit Connects in the U.S. each year, and about 15 percent of those are the five-passenger wagon versions, which are used by taxi companies and others. It expects to double that with the new wagon.

Rebecca Lindland, an automotive analyst with IHS Global Insight, thinks Ford is worrying too much about focus groups. Cave in and call it a minivan, she says.

?It?s a great-looking vehicle,? she said. ?I think they should celebrate the utility of it.?
