While the country waits for rulings from the Supreme Court on the Defense of Marriage Act and Proposition 8, states are rushing ahead to reform their own regulations on marriage.

Several states have bills coming up on their legislative dockets that would allow gay couples to legally marry in their states. Rhode Island's Senate Judiciary Committee and Delaware's House are both set to vote on same-sex marriage bills today. Minnesota and Illinois are also engaged in fights over whether to open up marriage to gay couples.

But the biggest news this week comes out of Nevada where Monday night the state Senate voted to repeal an amendment to the state Constitution banning gay marriage and replace it with one requiring Nevada to recognize the practice.

The debate that preceded the vote brought heated, emotional appeals from members of the state legislature.

For the first time Sen. Kelvin Atkinson, D-North Las Vegas, announced his very personal connection to the debate.

"I'm black. I'm gay," Atkinson told the assembly, according to the Las Vegas Sun. "I know this is the first time many of you have heard me say that I am a black, gay male."

Atkinson, a young single father and Chicago-native, has served as a Democratic member of the state's legislature for more than a decade.

His candor on the assembly floor was in step with his outspoken social media presence. Atkinson's Facebook, Twitter and Instagram posts offer glimpses of the person behind the legislator through family snapshots, sports commentary, an abundance of exclamation points and even a photo of the state senator in a hot tub with his dog.

As the bill was going to the floor, he shared a post that said, "The marriage equality bill is being heard is the Senate NOW?stay tuned for the results. *fingers crossed*"

With the bill's passage in the State senate it has begun the process of becoming approved in the state.

Stuart Gaffney of pro-gay marriage organization Marriage Equality USA sees states taking these votes into their own hands as a positive step for the nation.

"What we see all across the country is that peoples' opinions are changing very rapidly on marriage equality, actually faster than almost any other social issue of our time, and the reason is because people are getting to know their lesbian and gay friends, colleagues and neighbors - or in this case fellow members of the legislature - and realizing that the freedom to marry means the world to them but doesn't actually take away from anybody else," Gaffney told ABC News.

On the national level, several senators have recently come out in favor of gay marriage, starting with Sen. Rob Portman, R-Ohio, who cited his relationship to his gay son as the impetus for changing his mind. Gaffney noted President Obama and President Clinton also mentioned their daughters and daughters' friends as what brought them to support marriage equality for same-sex couples.

"These personal voices matter a lot whether we're talking to our neighbors or whether we're talking to our elected officials," he said.

But not all states are moving towards legalizing same-sex marriage. Tom McClusky, senior vice president of government affairs for the Family Research Council, pointed out that some, like Indiana, have opted to wait until after the Supreme Court ruling to vote.

He criticized those lawmakers who had changed their positions on the issue because of personal connections with gay Americans.

"In this case I think the legislators, in leading with their hearts and not with their minds, are making bad choices for their constituents," McClusky said.

Before Rhode Island's vote today, all five Republican members of the state Senate expressed support for gay marriage.

Their voices echoed Gaffney's thoughts on the national trend towards accepting same-sex marriage.

"Our Senate Republican Caucus is deeply committed to the values of freedom, liberty and limited government. In accordance with those values, we believe that freedom means freedom for everyone, and that every citizen of Rhode Island deserves the freedom to marry the person they love," the Republicans wrote in a statement Tuesday. "We recognize that there is a national consensus building on this generational issue, and we are glad that support for the freedom to marry is growing within the Republican Party."

What planets are made of: Findings establish counterintuitive potential planet-forming materials

Apr. 24, 2013 ? A team of researchers led by Artem R. Oganov, a professor of theoretical crystallography in the Department of Geosciences, has made a startling prediction that challenges existing chemical models and current understanding of planetary interiors -- magnesium oxide, a major material in the formation of planets, can exist in several different compositions. The team's findings, "Novel stable compounds in the Mg-O system under high pressure," are published in the online edition of Physical Chemistry Chemical Physics. The existence of these compounds -- which are radically different from traditionally known or expected materials -- could have important implications.

"For decades it was believed that MgO is the only thermodynamically stable magnesium oxide, and it was widely believed to be one of the main materials of the interiors of the Earth and other planets," said Qiang Zhu, the lead author of this paper and a postdoctoral student in the Oganov laboratory.

"We have predicted that two new compounds, MgO2 and Mg3O2, become stable at pressures above one and five million atmospheres, respectively. This not only overturns standard chemical intuition but also implies that planets may be made of totally unexpected materials. We have predicted conditions (pressure, temperature, oxygen fugacity) necessary for stability of these new materials, and some planets, though probably not the Earth, may offer such conditions," added Oganov.

In addition to their general chemical interest, MgO2 and Mg3O2 might be important planet-forming minerals in deep interiors of some planets. Planets with these compounds would most likely be the size of Earth or larger.

The team explained how its paper predicted the structures in detail by analyzing the electronic structure and chemical bonding for these compounds. For example, Mg3O2 is forbidden within "textbook chemistry," where the Mg ions can only have charges "+2," O ions are "-2, and the only allowed compound is MgO. In the "oxygen-deficient" semiconductor Mg3O2, there are strong electronic concentrations in the "empty space" of the structure that play the role of negatively charged ions and stabilize this material. Curiously, magnesium becomes a d-element (i.e. a transition metal) under pressure, and this almost alchemical transformation is responsible for the existence of the "forbidden" compound Mg3O2.

The findings were made using unique methods of structure prediction, developed in the Oganov laboratory. "These methods have led to the discovery of many new phenomena and are used by a number of companies for systematically discovering novel materials on the computer -- a much cheaper route, compared to traditional experimental methods," said Zhu.

"It is known that MgO makes up about 10 percent of the volume of our planet, and on other planets this fraction can be larger. The road is now open for a systematic discovery of new unexpected planet-forming materials," concluded Oganov.

This work is funded by the National Science Foundation and DARPA.

Boston bombing suspects killed MIT officer: police commissioner

WASHINGTON (Reuters) - Boston's police commissioner said on Sunday that the Boston Marathon bombing suspects killed an MIT police officer and had more explosives that authorities believe they intended to use.

"Tragically, Officer Collier from the MIT police was murdered by these individuals as they started their rampage," Boston Police Commissioner Edward Davis said on "Fox News Sunday."

Sean Collier, 26, of the Massachusetts Institute of Technology campus police, was fatally shot on Thursday while sitting in his police cruiser as events began to unfold that led to the death of Tamerlan Tsarnaev, 26, and the apprehension of his brother Dzhokhar, 19, after a massive manhunt.

They were suspects in the bombing at the Boston Marathon on Monday that killed three people and injured 176.

"I just want to say on Officer Collier, I believe that he was attacked and his murder led to our apprehension of these individuals," Davis said. "Tragically, he paid with his life, but these individuals were out to kill other people."

Davis said the suspects had other explosives, which authorities have detonated. "We feel that they had plans to use those explosives, possibly on soft targets," he told the Fox program.

Asked if there were concerns about an ongoing threat, Davis said, "We are confident that these were the two actors, these were the two individuals that were carrying out this mission and they are either dead or arrested at this point."

He said Dzhokhar Tsarnaev was in "serious but stable condition" in a Boston hospital and was "in no condition to be interrogated at this point in time."

Transit officer still critical after shootout

CAMBRIDGE, Mass. (AP) ? Doctors say the Boston transit police officer wounded in a shootout with the marathon bombing suspects had lost nearly all his blood and his heart had stopped from a single gunshot wound that severed three major blood vessels in his right thigh.

Surgeons at Mount Auburn Hospital in Cambridge say 33-year-old Richard Donohue is in stable but critical condition. He is sedated and on a breathing machine but opened his eyes, moved his hands and feet and squeezed his wife's hand Sunday.

Emergency workers started CPR on the scene to restart his heart. Doctors say he is expected to make a full recovery and that nerves and muscles in his leg are intact.

Transit officials say Donohue had gotten out of his cruiser and was shooting at the suspects when he was hit.

Egypt's Mubarak stays jailed despite release order

CAIRO (AP) ? An Egyptian court on Saturday ordered the release of Egypt's deposed President Hosni Mubarak pending further investigation into corruption charges, but he will continue to be imprisoned on two other corruption cases.

The decision by a misdemeanors court in Nasr City came days after another court ordered Mubarak released pending his retrial in a separate case alleging responsibility for the deaths of nearly 900 protesters during the 2011 uprising against him. In that case, an appeals court in January threw out a life sentence against him, granting him a new trial, which is set to resume May 11.

Talaat Abdullah, Egypt's prosecutor general, plans to appeal the latest release order.

Mubarak has been in detention since 2011 and currently is in Tora prison in Cairo.

Setting Mubarak free, even temporarily while on trial, is a contentious issue in Egypt. Many perceive the release as evidence of the failure of the revolution to achieve justice and hold former regime officials accountable. Others, who contend his release is justified, are increasingly frustrated with what they see as incompetent leadership by Mubarak's successor, Mohammed Morsi, and the Muslim Brotherhood from which he hails.

The court order came a day after violent street clashes erupted between proponents and opponents of Morsi. The violence was sparked when the president's Muslim Brotherhood backers took to the streets to call for a "cleansing" of the judiciary and for loyalists of the former regime to be purged from state institutions.

Egypt's secular-minded and liberal opposition rejected their call. They deemed it a cover for upcoming measures by Morsi and the country's temporarily parliament to liquidate the judiciary and infuse their own members in a way to monopolize the judicial branch.

The judiciary has been a significant battleground in the political unrest that has swept Egypt during the past two years since Mubarak's ouster.

It is the sole branch of government not dominated by Morsi's Islamist allies. Some judges accuse Morsi of trying to undermine their authority, while the president's allies charge that Mubarak supporters in the courts are blocking Morsi and trying to derail Egypt's transition to democracy.

The country's economy has deteriorated, foreign reserves have been drained, tourism is on the slide and Egypt's attempts to secure a much-needed $4.8 billion loan from the International Monetary Fund have stumbled because of the political crisis.

The opposition has demanded that Morsi change the Cabinet, appoint a new prosecutor general and provide guarantees for fair and free elections.

In a posting Saturday on his official Twitter account, Morsi promised to reshuffle the Cabinet and appoint new governors.

"The qualified will be the ones taking responsibility to achieve the goals of the revolution," Morsi's posting read.

Sometimes You Just Gotta Roll | Black and Married With Kids.com ...

Growing up I was never the go with the flow type. I always asked questions. I wanted to know where we were going, why we were going, how long it was going to take to get there, and who would be there and so forth. The fact that my oldest is the same way shouldn?t surprise me, given I was doing the exact same thing 20 years ago. And here I am today, still asking a million questions, only this time, instead of asking my parents I ask my husband.

I think part of why I am this way is because I desperately want to be in control. After experiencing a period of time in my life when things were chaotic and out of control, I desperately wanted a life where things were predictable. If I knew what to expect, I could prepare to brace myself. Even the things that are good, such as surprises, kill me because I hate the unknown. But if life could be summed up in one word that word wouldn?t be predictable. It is far from that. No matter how hard you try to prepare or maintain control, life has a way of showing you, that in the midst of all your preparedness, life is happening and within a moment something can happen that can cause your plans to change. Something can come up and suddenly you are forced to change the direction you were headed. Sometimes you have to go with the flow.

I am learning that this applies to various aspects of my life, one of them being when it comes to my marriage. My most recent lesson was this week as my husband advised me that he wanted me to go with him to an event with his coworkers and he had already made arrangements with his mother to watch the children. Despite my belief that he has been blessed with an amazing group of coworkers my mind flooded with thoughts ranging from how can I leave my babies, I am not going to have time to clean up, your mom is watching the girls and I don?t want her to come over and the house is a mess, have you seen my hair, I have nothing to wear?the things I was stressing out about were all, for the most part, petty but tugging away at me and preventing me from simply saying ?ok babe.? Words that I imagine would have been music to my husband?s ears.

It wasn?t until after I had stressed myself out trying to get ready and straighten up and pump breast milk that I remembered the conversation I had with my mom just hours before. I told her how excited my husband had seemed and how I felt like he was up to something. I had a feeling he was taking me on a date. He got up early and put the breast pump together for me before he left for work and he checked in with me to see how things were going. We are going to have a good night he said as he expressed his excitement over us going out. I of course went into some dialogue about the pile of laundry and dishes and work that had not been done and how the dog kept waking up the baby. He, however, remained happy and told me not to worry. It would be fine. The girls would be fine. I would be fine.

I thought about how each time he said he was excited I countered back with something I had to do, or a suggestion that we should stay home. I thought about how sometimes we complain when we feel like our spouses aren?t making enough effort. ?And when they do, instead of showing excitement or appreciation, we drag our feet or spend all our time sweating the small stuff. I wonder what that did to his spirit when each time he said he was excited I grew quiet or told him how uncomfortable I have been in my own skin lately and that I would rather not go.

As we walked out the door headed to the car I decided it was time to just roll (better late than never right?). No more questions, no more stressing out about leaving my babies, no more obsessing over my clothes or hair. He was excited and that mattered.

I turned out to be right. He surprised me by taking me to a restaurant I had wanted to go to for the longest time. Earlier I had reflected on a time when he had tried to surprise me and I ruined it for him by being so negative. I ruined it because I couldn?t just roll. But on this night, we had a wonderful time and my husband seemed quite proud of his ability to plan a ?surprise date? for us given we have only gone on a couple since our littlest arrived in August. I have such a hard time leaving my children, especially the baby, but I know it is important for my husband and I to have time together, just us.

Had I kept complaining or pushed the fact that I didn?t feel like going out I would have missed out on an opportunity for my husband to bless me. Because that is what he did. As much as I want to know everything, sometimes the details don?t matter all that much. Sometimes what is most important is simply the fact that you are with the person you love. Where we were going and what we were doing wasn?t as important as the fact that my husband wanted to have an evening with his wife by his side. An evening where my focus was on him and not on my to-do list, my outfit or our precious children, a night where my numerous questions were replaced with oks and conversation.

I know I will continue to be challenged with my desire to be ?in the know;? however, going forward I will be making more of an effort to say yes and ok. I?m also going to make more of an effort to not focus so much on those minute things that, at the end of the day, are of little to no importance. Because sometimes, you just gotta roll.

Revolutionary new device joins world of smart electronics: New flexible, transparent, photosensitive device

Apr. 19, 2013 ? Smart electronics are taking the world by storm. From techno-textiles to transparent electronic displays, the world of intelligent technology is growing fast and a revolutionary new device has just been added to its ranks. Researchers at the University of Exeter have developed a new photoelectric device that is both flexible and transparent. The device, described in a paper in the journal ACS Nano, converts light into electrical signals by exploiting the unique properties of the recently discovered materials graphene and graphExeter. GraphExeter is the best known room temperature transparent conductor and graphene is the thinnest conductive material.

At just a few atoms thick, the newly developed photoelectric device is ultra-lightweight. This, along with the flexibility of its constituent graphene materials, makes it perfect for incorporating into clothing. Such devices could be used to develop photovoltaic textiles enabling clothes to act as solar panels and charge mobile phones while they are being worn.

Photosensitive materials and devices such as the one developed at Exeter can, in the future, also be used for intelligent windows that are able to harvest electricity and display images while remaining transparent. Smart materials have almost unlimited potential applications from integral iPods and keyboards in clothing to electronic displays on glasses and goggles.

Saverio Russo, Professor of Physics at the University of Exeter said: "This new flexible and transparent photosensitive device uses graphene and graphExeter to convert light into electrical signals with efficiency comparable to that found in opaque devices based on graphene and metals.

"We are only just starting to explore the interfaces between different materials at very small scales and, as this research shows, we are revealing unique properties that we never knew existed. Who knows what surprises are just around the corner."

Metallic nanostructures in smart materials typically cause a haze that prevents them from being truly transparent. The photosensitive device developed at Exeter contains no metals and is therefore completely transparent but, as it can detect light from across the whole visible light spectrum, it is as efficient at sensing light as other recently developed opaque photoelectric devices.

15 years after Good Friday Agreement, an imperfect peace in Northern Ireland

On this date in 1998, republicans and unionists put an end to the 'Troubles' that had ravaged the region for decades. But a permanent peace remains a more remote prize.

Fifteen years ago today, one of Europe's longest and seemingly most intractable conflicts came to an end. On April 10, 1998, Irish republicans and unionists signed the Good Friday Agreement, a peace accord that put a formal end to the "Troubles," a slow-burn civil war that had been going on in earnest since 1969.

Well, in fact, they didn't sign it. Nothing was actually signed on paper by the opposing sides. But they did agree to it, marking the end of the beginning of the Irish peace process.

The guns had already fallen silent two years previously, with both the Irish Republican Army and their unionist antagonists declaring a cease-fire within a six-week span. In the years that followed, a new British prime minister, Tony Blair, and his Irish counterpart, Bertie Ahern, worked to bring reluctant unionists to the table with their hated and feared old enemies.

And on this date 15 years ago, they succeeded: the Ulster Unionist Party agreed to work with republicans, something that would have been unimaginable just a short time earlier.

Life in Northern Ireland has been transformed since that day, no one disputes that. But the conflict has not been replaced with perfect peace. In July 1998, three young Catholic children were killed when the Ulster Volunteer Force, supposedly on ceasefire, firebombed their home. The infamous Omagh bomb, planted by dissident republicans, was to go off on August 15 of the same year, killing 29. And there have been murders carried out by both unionist and republican groups since then, as well as annualized rioting.

In some ways, the post-Good Friday state of affairs mirrors that of Northern Ireland prior to 1969, with sporadic episodes of violence punctuating a shaky peace. Still, with Irish republicans represented in government and Catholics no longer discriminated against in jobs, education, and housing, it is difficult to imagine the same sense of grievance that give birth to the conflict being nurtured ever again.

The problem, as with so many conflicts today, is that an honest desire to put an end to bloodshed and misery may not so much bring about peace as?transform violence into deep-frozen cultural and pseudo-political resentments.

In Northern Ireland, as elsewhere, there was no single winner or loser. Both sides can legitimately claim to have won, or to have lost. Whichever they claim depends on how they are feeling at any given moment. This year's rioting in Northern Ireland, sparked by a decision to fly the British Union flag over Belfast city hall on state occasions rather than every day, speaks of a unionist community that is brittle and fearful. A community that thinks it has lost. A community that feels abandoned and is itself now nursing a sense of grievance.

High-flown talk about plurality and neutrality simply do not reflect reality on the ground, except perhaps in a few well-to-do areas.
?
No one, other than a few extremists on the fringes of unionism and republicanism, wants to see a return to violence in Northern Ireland, and so the architects of the Good Friday Accord can rightfully claim a victory on that front. A permanent peace remains a more remote prize.

Pantech Vega Iron brings a 5-inch 'zero bezel' display, where zero equals 2.4mm (update)

Pantech Vega Iron brings 1080p on a 5inch display with indisputably thin bezels

We've got to admit that we saw some rumors about a "zero bezel" Pantech a few days ago, but ignored them because we had no idea what that meant. Now we do, however, as Pantech has made the 5-inch 1080p 720p phone official, under the solid-sounding name of the Vega Iron. The bezels aren't quite zero, but they are small: just 2.4mm across on each side, which -- for reference -- is roughly half the width on an iPhone 5. This results in a viewable-to-total area ratio of 75.5 percent, which Pantech claims is a world beater. Other specs include a quad-core 1.7GHz Snapdragon 600 processor, in-cell LCD display and Gigabit WiFi. We have no idea if Pantech has penciled the United States into the Vega Iron's release schedule, but the company is certainly trying to make an impression in this hemisphere and a phone like this couldn't hurt.

Update: The rumors were right about everything except the resolution, which now looks to be 720p rather than the big ten-eighty. Thanks to commenters who spotted the error.

Dot Earth Blog: Will Synthetic Biology Benefit or Threaten Wild Things?

Please look below for a ?Your Dot? missive on an emerging force that will, in ways both direct and indirect, shape the face of what we used to call ?nature? or ?wildlife.? The post was sent by?Cristi?n T. Samper, the president of the Wildlife Conservation Society, from a meeting held this week at Cambridge University to examine this question: ?How will Synthetic Biology and Conservation Shape the Future of Nature??

Will synthetic biology help or hinder conservation efforts?

This was the question asked at a symposium organized by the Wildlife Conservation Society at Cambridge University this week, attended by about 80 synthetic biologists and conservationists. ?These are two communities that have never come together and, like a first date, we were examining each other and building some trust.

It was clear that synthetic biology ? which involves the engineering of life ? was advancing rapidly and inevitably could impact the world?s biodiversity ? and could be either a positive or negative. ?The conservationists from WCS, The Nature Conservancy, WWF, Fauna & Flora International, and other leading groups and academic institutions, all wanted to know more.

There were a lot of questions flying: Could genetic manipulation allow species to adapt to climate change or control an invasive species? Could scientists change the biology of an organism to be more productive or enable it to grow in new environments? Could we manufacture wildlife products like ivory in a lab? Could this emerging science bring back species that have gone extinct like the passenger pigeon?

When the synthetic biology experts spoke, they focused on how their field is currently addressing the potential needs for food, energy and medicine. These could all have major impacts on conservation, improving agricultural yields or reducing the demand for wood, thus reducing deforestation. None of that has a direct impact on conservation but all could have an indirect effect. For example, what if there was an unintentional release of a synthetic organism and it destroyed all the fauna in an ecosystem? The scenarios are endless.

As a tropical biologist, the symposium became my first lesson in synthetic biology. The field was not around when I was a graduate student, and engineers approach the world very differently from scientists. I could easily see how the current focus of the synthetic biologists will affect our lives as humans very directly, but how will it evolve and affect the rest of the species on our planet?

When the conservationists left the meeting, we could see the potential of synthetic biology to help conservation. We left, however, with questions and hopes that this new science might ultimately be another one of the tools that we could use to save our threatened natural world ? which some surmise is approaching its sixth episode of extinction. Could we pool our intelligence with this new group of colleagues to finally turn back the clock on the demise of Earth?s great diversity of life?

Ed Yong, who blogs on science for National Geographic, has filed ?Can We Save the World by Remixing Life?? ? a great post surveying this nascent field and offering insights from those who attended the meeting.

The meeting was largely conceived by Kent Redford, a biologist who until recently was at the?Wildlife Conservation Society?and now is an independent consultant on conservation strategies.?Redford was the lead author of a new paper in?PLoS Biology?that laid the groundwork for the meeting, which ended Thursday. Japan, U.S. agree on Tokyo joining Trans-Pacific trade talks

TOKYO/WASHINGTON (Reuters) - Japan and the United States on Friday agreed on a deal paving the way for Tokyo to join talks on an Asia-Pacific free trade agreement, increasing the economic weight of the proposed pact and triggering a loud protest from U.S. automakers.

The deal brings Japan closer to entering talks on the Trans-Pacific Partnership (TPP), which the United States, Canada, Mexico, Peru, Chile, Vietnam, Malaysia, Singapore, Brunei, Australia and New Zealand hope to finish this year.

"I think Japan's national interests are protected under this U.S.-Japan agreement," Japanese Prime Minister Shinzo Abe told reporters on Friday after a meeting with cabinet ministers.

Abe, who took office in December, is making the regional free trade pact a keystone of his strategy to open Japan's economy and spur long-sought growth.

He is pursuing the agreement, despite fierce opposition from Japan's politically powerful farm lobby, as part of a "third arrow" in his "Abenomics" policy triad, after fiscal spending and drastic monetary policy easing.

President Barack Obama's administration sees the TPP as part of U.S. economic rebalancing toward Asia.

"Having Japan in TPP and contributing to the high standards of TPP is good for the U.S., it's good for the Trans-Pacific Partnership as a whole and its very good for the multilateral trading system itself," Mike Froman, White House international economic affairs adviser, told reporters in Washington.

With the entry of Japan, the world's third largest economy and fourth-largest U.S. trading partner, the final TPP pact is expected to cover nearly 40 percent of global economic output and one-third of all world trade, Froman said.

The United States also plans to launch free trade talks with the 27-nation European Union in coming months. With world trade talks dead in the water, regional initiatives have become the main forum for trade liberalization.

The TPP talks have been under way for three years and Japan hopes to participate in the negotiations beginning in July. But that requires a formal decision by all 11 countries currently taking part in the talks.

The U.S.-Japan agreement was applauded by the U.S. Chamber of Commerce and the Business Roundtable, but it got a chilly reaction from Detroit-based automakers that have lost substantial market share to Japanese competitors over past decades.

AUTO INDUSTRY CONCERNS

Ford Motor Co has fought hard to keep Japan out of the pact, arguing the U.S. ally has repeatedly failed to follow through on promises to import more foreign cars, and that the Japanese government has been driving down the value of the yen to help its automakers export more cars.

"It is stunning that the U.S. government would endorse a trade policy that puts the industry at a competitive disadvantage and comes at the cost of American auto jobs," Matt Blunt, president of the American Automotive Policy Council, said in a statement on the U.S.-Japan deal. "We urge the administration to reconsider its position."

Powerful U.S. lawmakers from Michigan, the traditional heart of the U.S. auto sector, also expressed concern.

Representative Dave Camp, the Republican chairman of the House of Representatives Ways and Means Committee, said he would not support Japan's entry into TPP without "airtight assurances" it will address longstanding barriers to U.S. auto, insurance and agricultural exports.

Representative Sandy Levin, the top Democrat on the Ways and Means Committee, who is also from Michigan, said the deal announced on Friday "does not provide an adequate basis for Japan's entry into the Trans-Pacific Partnership."

Levin vowed to use the next several months to push for tougher preconditions for Japan to join the talks.

U.S. trade officials said Tokyo agreed to a separate set of negotiations, in parallel with the TPP talks, focused on a number of regulatory and non-tariff barriers believed to keep U.S. autos out of the Japanese market.

"For the first time ever, we have the opportunity to negotiate a resolution of these issues in a way that is subject to binding and enforceable dispute settlement," Acting U.S. Trade Representative Demetrios Marantis said.

Japan also agreed the United States could phase out its auto tariffs, which are 2.5 percent on cars and 25 percent on trucks, over the longest period possible in the future TPP deal.

Levin criticized the commitment in that area, saying any phase-out of the U.S. tariffs should be linked to measurable improvement in sales of U.S. cars in Japan.

The Japanese Automobile Manufacturers Association welcomed Friday's announcement, but said the protracted process for eliminating U.S. tariffs was "regrettable."

"We look forward to the Japanese government's entering the TPP negotiations on a sure footing of promoting national interests and taking into account the views of our industry," said Akio Toyoda, the group's chairman.

Tokyo also pledged to expand its "preferential handling procedure" for imports, a simpler and faster certification method used by U.S. auto manufacturers to export to Japan.

That would allow U.S. companies to export up to 5,000 vehicles of each type of vehicle under the program, compared with the current annual ceiling of 2,000 for each vehicle type.

The White House still needs to give Congress 90-days notice before formally beginning talks with Japan. Marantis said it was premature to say when that would happen since some other TPP countries still have outstanding issues with Japan.

New Zealand Trade Minister Tim Groser said last month the TPP member nations could formally decide whether to allow Japan into the talks when trade officials meet in Indonesia on April 20-21 for the annual meeting of the 21-member Asia-Pacific Economic Cooperation forum.

(AP) ? Acclaimed film critic Roger Ebert has been praised at his funeral as a hero to his profession, a champion for the little guy and a visionary.

Ebert was remembered Monday at a downtown Chicago church. He died Thursday after a long battle with cancer.

Illinois Gov. Pat Quinn, Chicago Mayor Rahm Emanuel and Ebert's former Chicago Sun-Times boss John Barron spoke at the funeral. Ebert's widow, Chaz Ebert, also spoke, remembering her late husband as a "soldier for social justice."

Jonathan Jackson read statements from his father, the Rev. Jesse Jackson, and filmmaker Spike Lee.

The service had funny and serious moments. Emanuel joked that Ebert saw bad movies so the rest of us wouldn't have to. Ebert's stepdaughter, Sonia Evans, remembered him as "a world-class human being."

Olivia Wilde, Emma Stone team up for Revlon walk

(AP) ? Olivia Wilde and Emma Stone are getting ready to share the spotlight, and Wilde's fiance might be there, too.

Wilde and Stone will return as co-hosts of the 20th annual EIF Revlon Run/Walk for Women in New York on May 4, and Wilde says Jason Sudeikis may join her for the five-kilometer fundraiser.

Revlon and the Entertainment Industry Foundation also announced Monday that expectant mom Halle Berry will host the Los Angeles event for the seventh time. It's set for May 11.

The EIF Run/Walk for Women has drawn nearly a million participants and donated more than $68 million to support women's cancer research since it was established in 1994.

No word on whether Berry's baby-daddy, actor Olivier Martinez, or Stone's beau, "Spider-Man" star Andrew Garfield, will join the races.

Door still open on Iran atom talks, but not forever: U.S

ISTANBUL (Reuters) - U.S. Secretary of State John Kerry said on Sunday world powers would pursue further talks with Iran to resolve a decade-old dispute over its nuclear programme, but stressed that the process could not go on forever.

The six powers and Iran failed again to bridge wide differences at weekend talks in Kazakhstan, prolonging a stand-off that could yet erupt into a new Middle East war. No new talks were scheduled.

"This is not an interminable process," Kerry said after arriving in Istanbul on Sunday on the first leg of a 10-day trip to the Middle East, Europe and Asia.

He said U.S. President Barack Obama was committed to continuing the diplomatic process despite what he called the complicating factor of an Iranian presidential election in June.

"Diplomacy is a painful task ... and a task for the patient," Kerry told a news conference.

Western powers suspect Iran is trying to develop the means to produce nuclear weapons under the guise of a declared civilian atomic energy programme. Iran denies the accusation.

Israel urged the powers to set a deadline of weeks for military action to persuade Iran to halt its uranium enrichment activity. Prime Minister Benjamin Netanyahu, evoking Iran during a speech at a ceremony for Israel's Holocaust remembrance day, hinted that Israel would act alone if necessary.

"What has changed since the Holocaust is our determination and our ability to defend ourselves," he said. "We appreciate the international community's efforts to stop Iran's nuclear program, but at no stage will we put our fate in the hands of others, even our closest friends."

Tehran accuses Israel of threatening peace in the region and refuses to recognise the Jewish state, which is widely believed to harbour the Middle East's only nuclear arsenal.

European Union foreign policy chief Catherine Ashton, who represents the United States, Russia, China, France, Britain and Germany in talks with Iran, said the two sides had failed to resolve key differences during the two-day talks in Almaty.

"... It is important to continue to talk and to try to find common ground," Kerry said. "So we hope that out of Almaty will come a narrowing of some of the differences. We remain open and hopeful that a diplomatic solution can be found."

DEMAND FOR ENRICHMENT SUSPENSION

The six powers want the Islamic Republic to suspend its higher-grade uranium enrichment work in return for modest relief from international sanctions, an offer Iran did not accept.

Iran's most powerful figure, Supreme Leader Ayatollah Ali Khamenei, who has the last say on all state matters, has shown no sign of willingness to scale back Iran's nuclear activity.

"As a member of the Non-Proliferation Treaty (NPT), Iran has the right to enrich uranium ... The Islamic Republic will never stop its enrichment work," the head of parliament's Foreign Affairs and National Security Committee, Alaeddin Boroujerdi, said, according to Iran's ISNA news agency.

Boroujerdi was not speaking on behalf of Khamenei, whose stamp of approval is required for any substantive Iranian decision in the nuclear dispute.

But he also suggested that the Islamic Republic might even enrich uranium above the 20 percent level of fissile purity "for specific projects", a move that would increase alarm in Western capitals. He did not elaborate.

Iran says it is refining uranium to 20 percent - well above the 5 percent suitable for nuclear power stations - to convert into special fuel for Tehran's medical research reactor.

But 20 percent is a significant technical advance toward the bomb-grade threshold and some analysts believe Iran now has enough of this material to run the reactor for many years, raising Western suspicions that the growing stockpile may really be a potential reserve for weapons.

Some diplomats and experts have said Iran's June presidential election has raised uncertainty in the West over the Islamic Republic's strategy for nuclear diplomacy.

"Obviously there is an election and that complicates the choices with respect to the politics of Iran, and we are aware of that," Kerry said.

"But we will continue. The president (Obama) has determined to continue to pursue the diplomatic channel ... We remain open and hopeful that a diplomatic solution can be found."

(AP) ? Anne Smedinghoff had a quiet ambition and displayed a love of global affairs from an early age, joining the U.S. Foreign Service straight out of college and volunteering for missions in perilous locations worldwide.

So when the 25-year-old suburban Chicago woman was killed Saturday in southern Afghanistan ? the first American diplomat to die on the job since last year's attack in Benghazi, Libya ? her family took solace in the fact that she died doing something she loved.

"It was a great adventure for her ... She loved it," her father, Tom Smedinghoff, told The Associated Press on Sunday. "She was tailor-made for this job."

Anne Smedinghoff grew up in River Forest, Ill. ? an upscale suburb about 10 miles west of Chicago ? the daughter of an attorney and the second of four children. She attended the highly selective Fenwick High School, followed by Johns Hopkins University, where she majored in international studies and became a key organizer of the university's annual Foreign Affairs Symposium in 2008. The event draws high-profile speakers from around the world.

Those who knew Smedinghoff described her as a positive, hard-working and dependable young woman.

While a student in Baltimore, she worked part time for Sam Hopkins, an attorney near campus. He described her as ambitious "but in a wonderfully quiet, modest way."

Her first assignment for the foreign service was in Caracas, Venezuela, and she volunteered for the Afghanistan assignment after that. Her father said family members would tease her about signing up for a less dangerous location, maybe London or Paris.

"She said, 'What would I do in London or Paris? It would be so boring,'" her father recalled. In her free time, she would travel as much as possible, her father said.

Smedinghoff was an up-and-coming employee of the State Department who garnered praise from the highest ranks. She was to finish her Afghanistan assignment as a press officer in July. Already fluent in Spanish, she was gearing up to learn Arabic, first for a year in the U.S. and then in Cairo, before a two-year assignment in Algeria.

Secretary of State John Kerry said Sunday at a news conference in Turkey that Smedinghoff was "vivacious, smart" and "capable." Smedinghoff had assisted Kerry during a visit to Afghanistan two weeks ago.

He also described Smedinghoff as "a selfless, idealistic woman who woke up yesterday morning and set out to bring textbooks to school children, to bring them knowledge."

Her father said they knew the assignments were dangerous, though she spent most of her time at the U.S. Embassy compound. Trips outside were in heavily armored convoys ? as was Saturday's trip that killed five Americans, including Smedinghoff. The U.S. Department of Defense did not release the names of the others who died: three soldiers and one employee.

"It's like a nightmare, you think will go away and it's not," he said. "We keep saying to ourselves, we're just so proud of her, we take consolation in the fact that she was doing what she loved."

Friends remembered her Sunday for her charity work too.

Smedinghoff participated in a 2009 cross-country bike ride for The 4K for Cancer ? part of the Ulman Cancer Fund for Young Adults ? according to the group. She served on the group's board of directors after the ride from Baltimore to San Francisco.

"She was an incredible young woman. She was always optimistic," said Ryan Hanley, a founder of the group. "She always had a smile on her face and incredible devotion to serving others."

Johns Hopkins officials mourned her death in a letter on Sunday to students, faculty and alumni. Smedinghoff graduated in 2009. In the letter, University President Ronald J. As thousands of Davids prepare to take on the sports world?s Goliath in the NFL concussion lawsuits, Goliath has a fairly large stone that he?s about to drop on all of them.

Lost in the sympathy and intrigue generated by 4,200 former pro football players suing the caretakers of the game they played is the fact that the NFL, as it usually does, has some strong legal arguments.? The first one makes its way to Judge Anita Brody?s court in Philadelphia on Tuesday, after the submission of extensive written materials by the lawyers.

The NFL?s threshold position comes from the labor deal.? The league believes that the various Collective Bargaining Agreements negotiated by the players and the league control the situation, and that any claims for failure to protect players from concussions or to disclose to them the risks of concussions should be pursued via the dispute-resolution system created by the CBAs.

?Although the CBAs have changed over time pursuant to the collective bargaining process, every CBA expressly addresses player health and safety and provides grievance procedures for the resolution of disputes,? the league explained in a submission to the court, via the Philadelphia Inquirer.

The former players obviously disagree, but it?s common in situations like this for the employer to argue aggressively and loudly that workers who have banded together to form a union must rely on the less formal system of dispensing justice that the labor agreement creates.? The workers don?t prefer that approach because it removes from the process a jury of lay persons who could be inclined to decide the case based on dynamics other than the law and the facts.

A jury is far more likely to feel sorry for the former players than an arbitrator would.? Likewise, a jury would be much more inclined to resolve doubt in favor of the players, given the perception that the league has more than enough money to pay a verdict.? Throw in the idea that the men who made the game what is it today earned peanuts in comparison to the amounts paid to today?s players and coaches and executives and owners, and it becomes very easy for a jury to sidestep a morass of conflicting scientific contentions and legal arguments and decide to redistribute the wealth based on a visceral notion of fairness.

That?s why the NFL is fighting so hard to push the case from a court of law to arbitration.? And that?s why this initial skirmish in the concussion litigation will have a dramatic impact on the ultimate outcome of the case.

Tax haven data leak names names, raises questions

PARIS (AP) ? It's a data leak involving tens of thousands of offshore bank accounts, naming dozens of prominent figures around the world. And new details are being released by the day ? raising the prospect that accounts based on promises of secrecy and tax shelter could someday offer neither.

Among those named include a top campaign official in France, the ex-wife of pardoned oil trader Marc Rich, Azerbaijan's ruling family, the daughter of Imelda Marcos and the late Baron Elie de Rothschild. The widespread use of offshore accounts among the wealthy is widely known ? even Mitt Romney acknowledged stashing some of his millions in investments in the Cayman Islands.

But this week's leak, orchestrated by a Washington-based group called the International Consortium of Investigative Journalists, appeared to be the broadest in what has been a steady stream of information emerging about hidden money in recent years amid a wave of anger targeting the super-rich in an age of austerity.

The leak allegedly involved records from 10 tax havens, where the world's wealthy have long stashed funds. It uncovered a shadow network of empty holding companies and names essentially rented out to fill out boards of non-existent corporations, including a British couple listed as active in more than 2,000 entities, according to The Guardian newspaper, which participated in the global undertaking.

The project started with the receipt of a hard drive by an Australian journalist, Gerard Ryle, who took the data with him when he joined the consortium, according to the project's website. The group, a project of the Washington-based Center for Public Integrity, has said the hard drive arrived in the mail.

"We know the data is valid. We know who originally produced the data and we've done massive crosschecks to make sure what we're getting is accurate and isn't corrupted," said Michael Hudson, a senior editor on the project.

Rudolf Elmer, who once ran the Caribbean operations of the Swiss bank Julius Baer and turned whistleblower after he was dismissed in 2002, told The Associated Press that he considers the data to be authentic.

"This comprehensive information is like a torch that will probably set off a wildfire and bring to light a lot more about secretive tax havens," he said.

The secret bank accounts of the rich and powerful have recently come under a crush of whistle-blowing scrutiny.

France's former budget minister, Jerome Cahuzac, was forced to resign last month after a French investigative website unrelated to the latest leak revealed that he held offshore accounts ? a particularly damaging scandal because he was spearheading a campaign against tax evasion. In 2010, a Greek journalist published a list of about 2,000 people holding undeclared Swiss bank accounts, disclosures that triggered a firestorm of outrage as Greeks were forced to swallow brutal austerity measures.

In November, an HSBC insider leaked a list of more than 8,000 customers with accounts based in Britain's tiny Jersey Island, drawing an immediate tax investigation from Britain's revenue and customs service. Two years before that, a former HSBC employee stole account details for 24,000 clients. Germany, eager to learn about its own tax cheats, promptly offered to buy the information.

"This just shows what we all know, which is that for decades we have seen the emergence of globalization on the one hand and governments that were unable to coordinate and cooperate on the other hand," Pascal Saint-Amans, head of tax policy for the Organization for Economic Cooperation and Development, said Friday.

There is nothing inherently illegal about opening bank accounts overseas, but it's well known that the wealthy use them to avoid higher taxes at home ? a practice that Saint-Amans said was quickly falling afoul of governments desperate for revenue, especially those suffering in the European financial crisis.

Britain has an outsized share of offshore territories, which include the British Virgin Islands, Bermuda, the Cayman Islands and the Channel Islands, whose 4? square miles (12 square kilometers) are saturated with current and former British company directors, according to The Guardian.

"Britain has this network of satellite tax havens around the world that have been acting as feeders," said Nicholas Shaxon, author of the book "Treasure Islands."

Shaxon said he was encouraged by the succession of whistleblowing employees over the years, and described the latest leak as the most significant to date.

"I hope this has created a new willingness among players who are inside the system to say, 'Hang on, maybe this isn't such a good thing,'" Shaxon said.

French President Francois Hollande, who has promised to clean up France's finances, has had a particularly bad week when it comes to news about tax havens. No sooner had Cahuzac acknowledged lying about his offshore accounts than news emerged in the newspaper Le Monde that his former campaign treasurer, Jean-Jacque Augier, was a shareholder in two firms in the Cayman Islands, through a holding company.

Augier said he did nothing wrong. Cahuzac was felled by a recording of him talking about his accounts that was leaked to French website Mediapart.

The International Consortium of Investigative Journalists consortium promised Friday to continue publishing details in coming weeks. Hudson, the senior editor, said the goal was to shed light on an industry that has thrived on secrecy.

"It becomes a question of not necessarily right or wrong, but it is a question of how our world works and how some folks who have the wherewithal to use havens get a degree of secrecy and tax benefits that average folks don't have access to," he said.

Tim Ridley, former chairman of the Cayman Islands Monetary Authority, warned against any satisfaction people may get from seeing the private banking information of the wealthy splashed across the Internet.

"Whatever may happen with offshore accounts today with everybody smiling about it could happen to onshore accounts in London or New York tomorrow," Ridley said. "Normally people are entitled to information about their financial affairs or their medical affairs to be private."

Ridley said there remained entirely legitimate reasons to set up accounts offshore, even for individuals, especially those from volatile countries: "Unstable governments have a habit of taking people's money in unjustified circumstances."

Shaxon was less concerned about the rights of wealthy individuals holding secret bank accounts.

"I don't think we should be worried about the sensitivities of the poor banker and poor criminals whose criminal activities are being exposed," he said. "If there are people who are doing nothing wrong and their information is being exposed, then it's collateral. It's a price to be paid."

Both Ridley and Shaxon ? coming from entirely opposite perspectives ? agreed that the disclosures dented the world of offshore banking, but were hardly a fatal blow.

And experts say it will take years for current efforts against secrecy to fully take hold.

"It is ultimately public pressure that is going to make a difference here," Shaxon said.
